1. Who we are and How to Contact Us

www.designergiving.co.uk is a site operated by Designer Giving Limited (“we”, “us” or “our”). We are registered in England and Wales under company number 15830669 and have our registered office at Heywood Hall, College Road, Denstone, Uttoxeter, Staffordshire, ST14 5HR.

2. About our Site

2.1 Designer Giving is an online marketplace where independent sellers can list designer and luxury fashion items with a minimum sale price of £25. Business sellers (including Designer Giving Limited for DG Shop items) may list from £5.

2.2 All sellers must donate a minimum of 10% of the sale price to a children’s charity of their choice. The seller can nominate a charity via their account for the item they upload to the site.

2.3 Designer Giving acts primarily as an intermediary marketplace between buyers and sellers except where Designer Giving is expressly stated to be the seller of an item.

2.4 We own and manage the Designer Giving site where we provide the following services:

  • hosting, where we act as an intermediary between sellers and buyers for the sale of items on the site;
  • sales, in order to sustain our business, we will also sell items on this site. Where we are the seller, additional terms as set out below will apply. We will clearly state on the site where we are the seller of the item and we will also donate a minimum of 10% to one of the charities for each sale.

2.5 We are responsible for the services we provide, within the limits of applicable laws and our commitments, and under the conditions set out in these terms.

3. By using our site, you accept these terms

3.1 By using our site, you confirm that you accept these terms and you agree to comply with them.

3.2 If you do not agree to these terms, you must not use our site.

4. There are other terms that may apply to you

4.1 These terms refer to the following additional terms, which also apply to your use of our site:

5. About you

5.1 To use our site, you must:

  • be at least 18 years old,
  • register for an account whether you are selling or buying an item,
  • use our services for your personal benefit unless you notify us during the creation of your account that you are a business seller, in which case you will need to comply with the additional terms applicable to a business seller,
  • have the capacity and rights to be able to carry out transactions via our site, and
  • agree to these terms and where applicable the terms applicable to a business seller.

5.2 You will be:

  • a seller, who lists goods to sell (each, an item) on the site; and/or
  • a buyer, who can view, search and buy an item by clicking the buying button, providing their payment details and clicking the “Pay” button (each a transaction).

6. What items can you sell

6.1 We want Designer Giving to be a friendly and safe place for its users. We must make sure that you follow basic rules for the items.

6.2 You can sell:

  • designer women’s, men’s and children’s clothing, footwear and accessories;
  • new tagged items as long as you have permission to sell them.

6.3 You cannot sell:

  • items prohibited or restricted by law, including counterfeit items, replica or imitation items, stolen goods, firearms, weapons or dangerous goods;
  • items that do not comply with hygiene standards or may pose health or safety risks, such as worn underwear;
  • medicinal products, food and tobacco products;
  • items that simply do not align with the Designer Giving vision, including animal fur and fur products.
  • Counterfeit, replica or imitation items are strictly prohibited. We reserve the right to remove any listing we reasonably suspect to be counterfeit, fraudulent, stolen, unlawful or otherwise inappropriate.

7. Creating an account

7.1 To create your account and keep it secure, you’ll need to provide us with your email and if you are a buyer, a unique username and password will be assigned to you. You can amend this in your profile if you wish. If you are a seller you can choose your own username and passwords.

7.2 Disposable or masked emails can’t be used to create your account. You must treat such information as confidential. You must not disclose it to any third party.

7.3 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms.

7.4 If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at enquiries@designergiving.co.uk.

7.5 During the account registration process, and at any time during your use of our services, we might ask you to:

  • help us verify information on your account (like your phone number, email or payment method),
  • provide additional relevant information,
  • remedy any incorrect or incomplete information on your account, or
  • answer security questions.

7.6 By this we verify that you are the person accessing your account and/or making transactions on the site. If the information you provide is incomplete or incorrect, or if you don’t cooperate with our requests, we may either take corrective measures or block your account as described further below.

7.7 You are allowed to have only one account. If we block your original account because someone unlawfully took it over, you can create a new account for yourself.

7.8 If you are a seller on creation of your account, you will also need to register for a Stripe account if you do not already have one to facilitate the payments via the site.

7.9 Please be aware if you are new to Stripe there may be a delay in payments being made to you. Full details will be outlined in Stripe’s terms and conditions. We cannot control or take responsibility for Stripe verification or payout delays.

8. Your obligations when using the site

8.1 You agree to do the following when you use our site and the services:

  • comply with these terms (and where applicable the business seller terms) and applicable laws,
  • provide us with accurate and up-to-date information about yourself and immediately update your account if your information changes,
  • keep your account login details and password confidential and tell us if you think someone might have unlawfully taken over your account,
  • only share information from the site with third parties, including on social media, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice, and
  • remain responsible for and have all rights to information, photographs or other data you upload on our site (referred to as “content”).

8.2 You agree you will not:

  • do anything illegal, unethical, contrary to public security or that infringes our or someone else’s rights (like their privacy, confidential information or intellectual property),
  • upload, list, sell or attempt to sell counterfeit, replica, imitation, stolen, fraudulent or misleading items,
  • use any kind of external software tools (including but not limited to: bots, scraping programs, crawling programs, spiders) when registering on the site and/or when using the site and/or Services, unless such a use is authorised, offered or in any other way allowed by us,
  • use any external software tool that could disrupt the normal operation of the site or services or infect or damage another user’s computer,
  • adapt, copy, edit, distribute or commercialise any content on the site without our prior written consent,
  • data mine, screen scrape, crawl, disassemble, decompile or reverse engineer any part of the site,
  • publish content that promotes, encourages or incites terrorism, racism, revisionism, xenophobia, homophobia, sexism, hate speech, discrimination, human trafficking, organized crime, illegal organizations, self-injury, suicide, torture, cruelty to animals, apology of war crimes, sexual exploitation of children and/or adults, cults or other unlawful content,
  • delete and re-list the same item multiple times or multiple items in bulk,
  • collect, hold or disclose information you obtained illegally that relates to other users, their content or their actions on the site, or any information appearing on our site if it might affect the rights of other users,
  • promote other websites or companies via advertisements on our site.

9. How we can use your Content

9.1 To the extent permitted by law, you allow us to have a non-exclusive right to use your content worldwide, without consideration, during the applicable rights’ duration. This means we can copy, display and adapt your content for operational, commercial, advertising or other internal business purposes and on any type of platform or media including on the internet (in banners and articles, on other websites) and on social networks (Facebook, Twitter, Instagram, etc.).

10. Selling an item

10.1 Standard marketplace sellers must list items with a minimum sale price of £25. Business sellers may list from £5. It is your responsibility to determine the sale price for the item.

10.2 You must have the legal right to transfer ownership of an item to a buyer i.e. the item legally belongs to you or you otherwise have full authority to sell it.

10.3 All items listed must be genuine and authentic. Counterfeit, replica or imitation items are strictly prohibited.

11. Authentication requirements

11.1 Authentication requirements on the platform are as follows:

  • items under £200 - authentication is optional;
  • items between £200 and £399 - independent authentication is strongly recommended; and
  • items valued at £400 or more - independent authentication is mandatory before listing.

11.2 We may request proof of authenticity at any time. Failure to provide satisfactory evidence may result in removal of the listing, cancellation of a transaction, suspension of your account or permanent removal from the platform.

11.3 Designer Giving does not independently guarantee the authenticity of items listed on the platform unless expressly stated otherwise in writing.

12. Item condition and descriptions

12.1 To list an item for sale on the site, you will need to take and upload clear photographs and write a complete and accurate description of the item that accurately reflects its quality, condition and appearance and includes details of any wear, marks, defects, damage, alterations or missing parts.

12.2 Items should be described honestly using the following condition guidance:

  • New - unused and with original tags attached
  • Like New - minimal signs of wear, no tags
  • Gently Used - visible signs of normal use
  • Used - significant wear, marks or imperfections.
  • Vintage - older, classic piece

12.3 If an item differs materially from its description or photographs, contains undisclosed defects or is counterfeit, the buyer may be entitled to a refund.

12.4 If you are a business seller you will need to highlight clearly in your listing that you are a business seller and provide the buyer with clear contact details. As a business seller you must comply with all applicable consumer protection laws, including cancellation rights, refund rules and information obligations.

12.5 Once your item is published on the site, this means you officially put forward an offer for sale which can be accepted by a buyer.

12.6 You can withdraw an item at any time before a buyer purchases the item.

12.7 You will receive a notification once a buyer has agreed to buy an item. You are responsible for arranging the shipping of the item to the buyer.

12.8 All items must be sent using a tracked delivery service.

12.9 Sellers must obtain appropriate insurance cover for the full value of the parcel during transit.

12.10 You must ship the item to the buyer within 7 days of the date they agree to buy the item or in accordance with your own shorter shipping deadline that you stated when listing the item for sale.

12.11 Risk in the item remains with the seller until delivery to the buyer has been completed.

12.12 The seller will be responsible for any lost, damaged or undelivered parcel and will need to claim compensation from the carrier directly.

12.13 Where an item is confirmed as lost, damaged or undelivered, the seller may be required to refund the buyer the full sale price, including any applicable delivery charge and Designer Giving will refund the platform fee and charity donation. This allows the seller to re-list the item again without having to donate twice.

12.14 Unless you are a business seller, the buyer should notify sellers through the platform of any issue within 7 days of delivery. If no issue is raised within 7 days of confirmed delivery, the transaction will normally be treated as complete for the purposes of the Designer Giving dispute process. This does not affect any statutory rights available under applicable law.

12.15 Private seller purchases are not eligible for returns solely because a buyer changes their mind, item doesn't fit or item doesn't suit unless the seller agrees otherwise.

12.16 For every sale you will be responsible for the following fees which will be deducted from the sale price:

  • transaction fee, which will be approx. 2% (dictated by STRIPE) of the total of the sale price and the shipping costs plus 20 pence;
  • platform fee, which is 7% of the sale price ONLY;
  • 10% minimum of the sale price will be taken as a charity donation or more if you have pledged more via your account.

12.18 These amounts will be inclusive of VAT, if applicable.

12.19 We have a random selection policy for the homepage of the site where featured items will be listed at random and changed regularly at random. Listed items will appear according to the date upon which they were listed.

13. Buying an item

13.1 To purchase an item from the site, you will need to:

  • click the buying button,
  • select a payment method and delivery option, and
  • click the paying button on the checkout page.

13.2 For every transaction, you will pay the following fees:

  • sale price, and
  • shipping costs (unless the seller is offering free delivery).

14. Private seller transactions

14.1 Where an item is sold by a private seller, buyers do not have an automatic legal right to cancel, return or exchange an item simply because they change their mind.

14.2 However, buyers may be entitled to a refund where:

  • the item is materially different from its description or photographs;
  • the item contains undisclosed defects or damage;
  • the wrong item is received;
  • the item is counterfeit; or
  • the item does not arrive.

14.3 Buyers should notify sellers through the platform of any issue within 7 days of delivery.

14.4 If no issue is raised within 7 days of confirmed delivery, the transaction will normally be treated as complete for the purposes of the Designer Giving dispute process. This does not affect any statutory rights available under applicable law.

14.5 If the seller agrees to refund the sale price due to an issue with the item, the buyer will be responsible for returning the item to the seller unless the seller agrees otherwise or the law requires otherwise. When returning the item to the seller, the buyer must use a tracked delivery service and should obtain insurance for the full value of the item.

14.6 If the item has not been delivered within 14 days of dispatch confirmation, the buyer should contact the seller through the platform. If the buyer is refunded and the parcel is subsequently delivered, the buyer must arrange for the item to be returned to the seller.

15. When Designer Giving or another Business is the seller

15.1 When we, Designer Giving, or another business is the seller of an item it will clearly state this on the site. When buying an item from Designer Giving or another business seller via the site, you may have legal rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

16. Your buyer’s legal rights

16.1 You normally have 14 days to change your mind if you buy an item from Designer Giving or another business seller via the site.

16.2 You pay the costs of return unless the item is faulty, counterfeit, significantly not as described, the item listing states otherwise or the seller agrees otherwise.

16.3 You cannot change your mind about a purchase for items sealed for health protection or hygiene purposes once these have been unsealed after you receive them.

16.4 The following items may not be returned once opened, unsealed or used where this affects hygiene or resale suitability:

  • underwear;
  • swimwear where hygiene seals have been removed;
  • earrings;
  • cosmetics or skincare products; and
  • other hygiene-sensitive goods.

16.5 If you change your mind about an item, you must let the business seller know no later than 14 days after the day it is delivered.

16.6 To let us know you want to change your mind about an item sold by Designer Giving, contact enquiries@designergiving.co.uk. If you need to contact any other business seller, their details will be in the listing.

16.7 You must return your item within 14 days of telling the business seller that you have changed your mind. Returns are at your own cost unless the item is faulty, counterfeit or significantly not as described. You must send the item back using a tracked delivery service and retain proof of postage. You should obtain insurance cover for the full value of the parcel during return transit.

16.8 The business seller will refund standard delivery costs only. For example, they will not refund any extra you have paid for express delivery or delivery at a particular time unless legally required.

16.9 The business seller may reduce your refund if you have used or damaged an item. If you handle the item in a way which would not be acceptable in-store, the business seller may reduce your refund to compensate for its reduced value.

16.10 If you tell us you have changed your mind about an item that has not been dispatched, the business seller will refund you as soon as possible and within 14 days. If you are sending your item back, the business seller will refund you within 14 days of receiving the returned item or receiving proof of return postage, whichever occurs first. The business seller will refund you by the method you used for payment and will not charge a fee for the refund.

17. Dispute with an item

17.1 If a buyer is unhappy with an item, the buyer should contact the seller directly to try to resolve the issue between themselves.

17.2 Designer Giving acts primarily as an intermediary marketplace and is not generally responsible for the quality, legality, authenticity or delivery of items sold by third-party sellers except where required by law or where Designer Giving is itself the seller.

17.3 However, Designer Giving may investigate disputes, request supporting evidence, request authentication evidence, temporarily withhold payouts, remove listings, suspend accounts or take other reasonable steps where fraud, counterfeit concerns, non-delivery or misuse of the platform is suspected.

17.4 Nothing in these terms excludes any rights a consumer may have under applicable law.

17.5 If the item is sold by a business seller please contact them at the details provided in the listing with any issues.

18. Payments

18.1 Payments on the site are processed securely through Stripe.

18.2 By using the site, sellers agree to comply with any applicable Stripe terms and conditions and verification requirements.

18.3 Designer Giving does not directly store payment card details.

18.4 Seller payouts may be delayed where required for fraud prevention, verification checks, disputes, chargebacks or compliance purposes.

18.5 Where a chargeback, payment reversal or fraud claim occurs, Designer Giving reserves the right to recover associated sums from the seller where appropriate.

19. Donations

19.1 Each time a seller lists an item for sale on the site the seller can choose one of Designer Giving's approved children’s charities to whom they wish to donate.

19.2 A minimum donation of 10% of the sale price excluding the delivery costs will be deducted from the sale price prior to the sale price being paid to the seller.

19.3 All donations deducted from the sale price will be transferred within 48 hours to a separate holding account for the charity monies. These donations will be held until the end of the month in which they were received (unless they arrive less than 7 days before the end of the month in which case they will be transferred at the end of the following month).

19.4 Following the transfer to the chosen charity the seller will receive an email at the end of that month acknowledging the receipt of the donation with information pertaining to how those funds have been used and the difference that has been made.

19.5 All charities listed on the site are registered in the UK.

20. Our rights in connection with your account

20.1 If you breach these terms or undertake any unlawful activity, we reserve the right to carry out any of the corrective actions listed below:

  • send you a warning message that you need to follow these terms or if you are a business seller any additional terms relevant to you,
  • remove or automatically correct your items,
  • demote, hide or remove your content from the site,
  • restrict your account by blocking your access to certain features (like sending private messages or limiting visibility of your items to other users), or
  • notify local authorities about your activity if there’s a threat to someone’s life or safety.

20.2 We might block your account temporarily or definitively if:

  • we took a corrective action listed above and you continue to repeatedly breach these terms,
  • you commit a serious breach of these terms, meaning you provide us with incorrect, false or misleading information on your account or fail to keep your information up to date,
  • you do not cooperate with us when we try to verify information you provide on your account,
  • you upload, sell or attempt to sell counterfeit, stolen, fraudulent or unlawful items, or
  • you abuse the site’s functionalities.

20.3 When we block your account, this means:

  • you won’t be able to use the site except to contact our customer support team,
  • your items will be delisted from the site,
  • you can complete any pending transactions.

20.4 If we take a corrective action listed above or block your account, we’ll let you know:

  • our reasons for doing so,
  • the restriction we will apply to your content or your account,
  • the facts and legal grounds we relied on to make our decision, and
  • information about what recourse you have.

21. We may make changes to these terms

21.1 We may amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time. These terms were most recently updated on 19 May 2026.

22. Sending messages & leaving reviews

22.1 You can send private messages to other users to exchange information about an item. You must not use private messages for advertising, malware, unsolicited or mass messages, or any illegal, obscene, harmful, unethical, threatening, inappropriate or unlawful purpose.

22.2 After a transaction is complete, you can choose to write and publish a review about the transaction and other user. Reviews must be fair, honest and based on genuine experiences. We may remove reviews or content that breach these terms.

23. We may transfer this Agreement to someone else

23.1 We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

24. Our site is only for users in the UK

Our site is directed to people residing in the United Kingdom.

25. User-generated content is not approved by us

Our site may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

26. We are not responsible for websites we link to

26.1 Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only and should not be interpreted as approval by us.

26.2 We have no control over the contents of those sites or resources.

27. We are not responsible for viruses

27.1 We do not guarantee that our site will be secure or free from bugs or viruses.

27.2 You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own virus protection software.

28. You must not introduce viruses

28.1 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other malicious or technologically harmful material.

28.2 You must not attempt to gain unauthorised access to our site, server, database, equipment or network. You must not attack our site via a denial-of-service attack or distributed denial-of-service attack.

28.3 By breaching this provision, you may commit a criminal offence under the Computer Misuse Act 1990. We may report such breach to the relevant law enforcement authorities and cooperate with those authorities.

29. Our responsibility for loss or damage suffered by you

29.1 We do not exclude or limit in any way our liability to you where it would be unlawful to do so.

29.2 This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

30. Our responsibility to you as a business

30.1 If you are a business, we shall not be liable to you for loss of profit or any indirect or consequential loss arising under or in connection with any contract between us.

30.2 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any matter in respect of which it would be unlawful for us to exclude or restrict liability.

30.3 If you are a business, we exclude all terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982.

31. Entire Agreement

31.1 If you are a business seller these terms constitute the entire agreement between us in relation to your use of the site. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty which is not set out in these terms.

32. How we may use your personal information

32.1 We will only use your personal information as set out in our Privacy Policy at www.designergiving.co.uk/privacy-policy 

33. Which country’s laws apply to any disputes?

33.1 If you are a consumer, these terms of service, their subject matter and their formation are governed by English law. The courts of England and Wales will have exclusive jurisdiction, except that if you are resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident in Scotland you may also bring proceedings in Scotland.

33.2 If you are a business, these terms of service, their subject matter and their formation, including any non-contractual disputes or claims, are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
